Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Euthyn platform (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The service
Euthyn is a marketplace that connects Seekers with independent Providers (listeners, peer supporters, certified coaches, and licensed professionals). Euthyn is not a healthcare provider and does not provide medical, psychiatric, or therapeutic advice.Providers act in their individual professional capacity, not as employees of Euthyn.
2. Not a crisis service
Euthyn is not an emergency service. If you are in crisis or experiencing thoughts of self-harm, call your local emergency number or a crisis line immediately (in the US: 988). Do not use Euthyn to seek emergency help.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract. Providers must additionally hold and maintain any credentials they represent on their profile.
4. Accounts
You are responsible for your account credentials and for all activity under your account. Notify us immediately of any unauthorized access. Providing false information (including misrepresented credentials) is grounds for termination.
5. Bookings, payments, and refunds
- Sessions are booked and paid for in advance through Stripe.
- Euthyn retains a platform fee; the remainder is paid out to the Provider.
- Cancellations made at least 24 hours before the session receive a full refund. Later cancellations and no-shows are non-refundable except at the Provider's discretion.
- If the Provider fails to appear or the service was materially not as described, contact support@euthyn.com within 7 days for review.
6. Provider obligations
Providers agree to (a) maintain valid credentials and insurance where applicable; (b) operate within the lawful scope of their profession; (c) keep accurate availability; (d) not solicit clients off-platform to circumvent fees; and (e) comply with applicable law, including consumer protection and, where relevant, HIPAA.
7. Seeker obligations
Seekers agree to treat Providers with respect, to provide truthful information material to the session, and not to record sessions without the Provider's consent beyond any recording expressly offered through the Service.
8. Prohibited conduct
- Harassment, threats, discrimination, or hate speech.
- Impersonation or identity fraud.
- Scraping, reverse-engineering, or automated access except through documented APIs.
- Uploading malware or attempting to disrupt the Service.
9. Content you submit
You retain ownership of content you submit (journal entries, messages, reviews). You grant Euthyn a limited, worldwide license to host, display, and transmit that content solely to operate the Service. We may remove content that violates these Terms.
10. Disclaimers
The Service is provided “as is” without warranty of any kind. We do not warrant that Provider advice is accurate, effective, or suitable for your situation. You rely on any Provider's guidance at your own risk.
11. Limitation of liability
To the maximum extent permitted by law, Euthyn's aggregate liability arising out of or relating to the Service is limited to the amounts you paid to Euthyn in the 12 months preceding the event giving rise to the claim. Euthyn is not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold Euthyn harmless from claims arising out of your breach of these Terms, your content, or your violation of law.
13. Termination
Either party may terminate at any time. We may suspend or terminate your access immediately for a material breach. Sections that by their nature survive termination (including Sections 10–12) will continue to apply.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved by binding arbitration in Wilmington, Delaware, except that either party may seek injunctive relief in court.
15. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect.
